Terms & Conditions
As with any utility provider Digit Telecom Ltd has certain Terms and Conditions. These have been kept to a minimum.
1. Connection
1.1 Connection (mapping) will take place once the initial connection fee (if applicable) and the first lease payment has been received.
1.2 Mapping can only be to a geographic number provided by British Telecom or other public carrier.
1.3 Mapping will generally occur within 3 working days of Digit telecom being given an instruction to connect and details of the landline to which the connection is to be made. Digit Telecom will not be responsible for any delays in connection by the telecom company to whose equipment the number is being connected, or from whom the number has been sourced. No advertising/promotions/signs or stationery changes should take place until number allocation has been confirmed and actual connection made.
2. Rental/Charges
2.1 Line rental is to be paid monthly / quarterly / annually pre paid / in arrears as agreed) by standing order, credit card or cheque. Payment maybe altered from one method to another. Customers requiring additional information or advice should contact Customer Support all accounts are subject to VAT where applicable. Digit Telecom reserves the right to close accounts not used for a period of six months.
2.2 Rentals/payments not received within 30 days of becoming due will attract a late payment charge of £5.The customer should also be aware that if there are insufficient funds in/on their account/credit card to allow for a withdrawal, or fail to indicate the correct bank details on the application form, any bank/admin charges incurred will be payable by the customer and will automatically be deducted from any existing balance or added to the outstanding balance and recovered at a later date.
2.3 Should any rental remain unpaid for 3 months following due date the connection will be terminated. It will be reconnected upon payment of a £25 reconnection fee plus all outstanding rentals from due date until the date of reconnection. Should payment not be made within 30 days of termination then the number will be permanently disconnected and reallocated.
2.4 Whilst Digit Telecom will endeavour to maintain competitive rates, it reserves the right to vary the rental/rates without prior notice.
3. Redirection
3.1 In the event that you wish your number to be redirected so that it terminates over a different geographic number, this request will be actioned without charge on up to two occasions in any calendar year. Normally, redirection occurs as a result of moving to a different exchange area. Subsequent changes carry a £10 transfer fee. For temporary diversion Digit Telecom recommends that you set up call diversion with BT or your telecom supplier so that incoming calls will automatically divert to your mobile or nominated number.
4. Loss of Service
4.1 Digit Telecom accepts no responsibility for loss of service arising from matters outside its control.

5. Ownership & Transfer of Numbers
5.1 Ultimate ownership of all telephone numbers rests with the British government and not with the end user or supplying telephone company. You do however enjoy full use of your number(s) so long as the appropriate connection fee and ongoing rentals are paid, and that the number(s) are not being used for illegal purposes.
5.2 You may, if you wish, sell or transfer usage rights to your number so long as all rental payments are up to date. Transfers may not be made to any person or organisation whose purpose in acquiring the number is to use it in the carrying out of illegal/immoral activities. All transfers are subject to the approval of Digit Telecom Ltd
6. Connecting Telecom
6.1 In accepting service through Digit Telecom Ltd you also agree to accept the standard Terms and Conditions of the particular telecom company from which your chosen number has been sourced, and through whom it will be connected. Where this Agreement is deemed to be in conflict with the Standard Terms and Conditions of the telecom company referred to, then resolution shall be between Digit and that telecom company.
7. Termination
7.1 Notwithstanding payment of any connection fee, if any number is not connected and mapped to an underlying landline within 90 days of the date of this Agreement, and subsequently generating at least 250 minutes of inbound calls per month, then Digit Telecom may, at its discretion, terminate the connection upon reimbursement of the original connection fee (if any), less an administration charge of £50 per number.
8. Damages
8.1 Any claim for damages, for whatever reason, shall be limited to such sum(s) as may have been paid to Digit Telecom Ltd by the complaining party. Neither Digit Telecom Ltd, nor the connecting telephone company shall be liable for consequential losses arising through failure in service, failure to provide service, or any cause whatsoever.
9. Arbitration
9.1 Any dispute arising out of this Agreement shall be referred to arbitration under procedures agreed between Digit Telecom Ltd
And the Chartered Institute of Arbitrators or the Brighton/Hove branch of the Law Society.
10. Governing Law
10.1 This Agreement shall be governed and interpreted in accordance with English law.
